(in compliance with article 13 of the Personal Data Protection Code)

INTERESTED PARTIES: CLIENTS AND SUPPLIERS

The TEKNEL S.r.l. company, in their role in processing your personal data, in compliance with and in effect of Legislative Decree nr. 196 of 30^th June 2003 (Personal Data Protection Code), from hereon in referred to as “Privacy Code”, hereby informs you that the above-cited regulation provides for the protection of people and other subjects regarding the processing of personal data and that said processing will be carried out in a correct, lawful and transparent manner, protecting your privacy and rights.

Your personal data will be processed in full respect of the above regulation and in compliance with the confidentiality obligations upon which our Company’s activity is based.

In particular, we wish to inform you of the following:

1.    Purposes of the processing

 TEKNEL S.r.l. collects and processes the personal data of the interested parties to whom this report is aimed in order to undertake the obligations in the contractual or pre-contractual relations established with clients and suppliers, in particular for:

• Programming activities;
• Management of clientele and services carried out for the same;
• Management of Suppliers;
• Fulfilling of accounting and tax obligations;
• Legal department management;
• Client invoicing and supplier orders archives.

Data transfer is:

Any refusal, even legitimate, to supply the above-mentioned data may compromise the regular fulfilment of your relationship with our Company and, in particular, may make it impossible for TEKNEL S.r.l. to purchase from suppliers, dispatch clients’ orders, supply the services required and fulfil the relative invoicing.

In compliance with article 24 of the data processing code, the processing of your data may be carried out, limited to the above-mentioned purposes, without your explicit permission.

2.    Communication to third parties and distribution

The above-mentioned instances may also be fulfilled via the transfer and communication of data to third parties. Said third parties will only be those that are authorised to process said data in their role as delegates or external managers of the processing, to carry out or supply, while guaranteeing to protect the rights of the interested party, specific services that are strictly functional to the contractual relationship, such as:

• Banks and credit institutions;

• Controlling and controlled companies;

• Consultants and freelance professionals, including associates;

• External credit collection companies;

• Insurance companies;

• Technological service suppliers used by TEKNEL S.r.l.

The names and addresses of said subjects, previously named and authorised by TEKNEL S.r.l., are available upon request by the interested parties.

3.    Overseas data distribution and transfer

Data may be distributed but only in associated, anonymous forms and for statistical purposes.

If strictly necessary for the carrying out of the contractual relationship in course, your personal data may be communicated to third parties (such as suppliers) overseas, both within and outside of the European Union.

4.    Sensitive data

No data of a sensitive nature will be processed, in compliance with article 4, clause 1, letter d) ("sensitive data") and with article 26 ("sensitive data guaranted") of the Code (or rather any data wich "...reveals racial and ethnic origin, religious, philosophical or other beliefs, political opinions, support of parties, unions, associations or organisations of a religious, philosophical, political or union character, as well as any personal data that reveals the state of health and sex life").

5.    Processing conditions

TEKNEL S.r.l. processes the personal data of any interested parties in a lawful and correct way guaranteeing confidentiality and security of the same at all times. The processing is carried out, manually, telematically and via computer, with organisational methods and logistics that are strictly linked to the specified purposes.

In particular, all technical, computer, organisational, logistical and procedural security measures will be adopted, as provided for by Legislative Decree 196/2003 and “Attachment B” of the same decree, in order to guarantee the minimum level of protection of the data as provided by law.

Furthermore, the applied methods guarantee that the access to data is permitted only to those persons employed by our Company for data processing.

6.    Rights of the interested party

Regarding the processing of personal data, the interested party is granted all rights as provided for by article 7 of the Code, among which the right to:

1. be informed of the existence of personal data, even if not yet registered, which regards them, and the communication of such in an intelligible form;

1. be informed of:

   1. the origin of the personal data;

   2. the purposes and methods of processing;

   3. the logistics applied in the event of processing carried out with electronic tools;

   4. the identification of the Owner, Managers and designated representative;

   5. the subjects or categories of subjects who may receive the personal data or who may come into knowledge of the same in their role as State designated representatives, Managers or Employees;

1. regarding the data, receive:

   1. the updating, rectification or, where relevant, integration of the data;

   2. the cancellation, transformation in anonymous form or the block of any data processed in violation of the law, including that which does not need to be kept in relation to the purposes for which data has been collected or subsequently processed;

   3. the confirmation that the operations as provided for in letters a) and b) have been brought to the knowledge, even regarding the contents thereof, of those to whom the data has been communicated or distributed, except in the case in which said fulfilment is impossible or involves the use of means that are demonstrably disproportionate to the protected right; 
      

1. oppose:

   1. for legitimate reasons, the processing of any personal data that regards them, even if it is pertinent to the purpose of the collection;

   2. the processing of any personal data that regards them for advertising material or direct sale or for the fulfilling of market research or commercial communication.
